Terms & Conditions

This Booking Agreement is made between the Owner of the Property (or Owner's authorized agents, employees, successors and assigns) and the Client. Hereafter “the Client” refers to all the members listed on the Guest Registration list.
  •  
  • The Client is urged to preview the property/advertisement via the website www.liveinasia.com.
  •  
  • The Client agrees to take the property as advertised on the website. The Client is responsible to learn about the area of the rental property. The Owner is not responsible for relocating the Client once possession of the rental is taken.
  •  
  • The Owner reserves the right to cancel or rescind any Booking Agreement if it is found that the Client is conducting unlawful activities.
  •  
  • ALL INDIVIDUALS THAT WILL BE ON THE PROPERTY MUST BE REGISTERED ON THIS FORM. The Client certifies that only the individuals listed on the Guest Registration list will occupy the property. Any unregistered individuals will be considered unauthorized and additional fees of JPY 10,000 per person per night may be charged or the contract may be subject to immediate cancellation and forfeiture of all rents and fees received at the Owner's discretion. If the Client plans on entertaining more individuals than states on the Guest Registration list, the Client must obtain written permission from the Owner. When permitted, an additional charge may apply.

  • The Client shall occupy and use the premises only as a residential home and for no other purposes.
  •  
  • There will be NO PARTIES, GATHERINGS, OR OTHER EVENTS without the written consent of the Owner. The Client acknowledges that unauthorized events will result in an additional charge of a minimum of JPY 100,000 Unauthorized Event Fee per occurrence.
  •  
  • IF IT IS APPARENT THAT THERE ARE UNREGISTERED GUESTS AND/OR AN UNAUTHORIZED EVENT ON THE PREMISES AND/OR ANY VIOLATION OF OTHER TERMS AND CONDITIONS, THE OWNER RESERVES THE RIGHT TO ENTER THE PROPERTY TO REVIEW THE SITUATION AND AUTOMATICALLY IMPOSE FINES AND FEES.

  • Any misrepresentation about the nature or size of the group, use of the property or any other misrepresentation, or any breach of the Booking Agreement will result in an additional charge.
  •  
  • The Client acknowledges that the property is located in a residential area and shall KEEP NOISE LEVELS TO A MINIMUM AT ALL TIMES. Be extra courteous to your neighbors, particularly between 09:00pm and 08:00am (Remember, you are on vacation, but your neighbors live here and are going to work in the morning).
  •  
  • Rates include the use of gas, water, electricity and internet access, first use of toilet paper, soap, detergent, dish drops, fresh towels and linen for the number of the registered guests.
  •  
  • Rates do not include daily maid service, laundry service, telephone, car rental, food, liquor, gratuities, personal items and excessive cleaning upon departure (i.e.: upholstery or rug shampooing, etc.).
  •  
  • There is a JPY 5,000 charge for any approved change in reservation dates or properties. Changes are only permitted if the dates are available and are only granted at the Owner's discretion.
  •  
  • No landlord and tenant relationship shall be created hereby.
  •  
  • The Client shall be liable for all acts of the family, guests, and employees present on the property. Should there be any legal action arising from/relating to the occupant(s) use of the residence, the Owner shall be entitled to recovery of all legal fees and costs.
  •  
  • The Owner will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services, except as noted in the Cancellation and Refund Policy.
  •  
  • The Owner will in no way be responsible or liable for personal property lost due to theft, flood, fire, unforeseen circumstances, or natural disasters.
  •  
  • The Owner or its agents may enter the property at any time in the event of emergency and at all reasonable times to make necessary/requested repairs, show, or inspect the property.
  •  
  • The Owner reserves the right to switch the Client to another property, based on availability, or offer refund (if the property is not approved by the Client) due to an emergency, fire, sale, unforeseen circumstance, or natural disaster.
  •  
  • The Client will receive House Rules at check in and must abide by the rules while the Client are renting the property.
  •  
  • The Client agrees to pay a certain amount of cleaning fee at booking to clean the property thoroughly after the Client’s departure.
  •  
  • The Client acknowledges that a JPY15,000 refundable security deposit is required for all reservations to cover any damage, loss, theft of the property, and any extra or unusual cleaning, as determined by our cleaning staff, that may be required that exceeds the amount of the departure cleaning fee. This deposit will be refunded to the Client in the case that all terms and conditions of this agreement are met upon departure. Otherwise, the Owner reserves the right to take a photocopy (or a photo by camera) of client's credit card at Check-In and hold it until the Client’s Check-Out for the same purpose.
  •  
  • There will be NO EARLY CHECK-IN or LATE CHECK-OUT without prior approval by the Owner. Arrival prior to Check-In Time or Departure after Check-Out Time listed in the Booking Agreement may result in additional charges. The Client agrees to pay JPY4,000 if arriving later than 10:00 PM, or JPY12,000 if arriving later than 11:30 PM as a LATE CHECK-IN FEE. Also the Client agrees to pay 50% of one night's rent for extensions until 1:00 PM or 100% of one night's rent for Check-Out after 3:00 PM as a LATE CHECK-OUT FEE.

  • The Client shall check the property carefully before leaving and collect all items since the Owner is not responsible for personal items left behind by the client.
    If the Owner finds any items and the Client requests them to be returned, the Owner shall charge the cost of shipping and a JPY 3,000 ITEM RETURN FEE to the Client.
  •  
  • There will be NO SMOKING on the property, including common areas of the building, at any time. Failure to do so, which results in complaints from the Owner or neighbors or the following guest may result in a fine of up to JPY 50,000.
  •  
  • There will be NO PETS on the property.
  •  
  • Room Keys should not be duplicated. The Client shall incur a JPY 20,000 charge for each instance of lost room keys.
Release of Liability and Indemnification Agreement
In consideration for the right to occupy the vacation rental, the current occupants acknowledge and agree to the following:

  • The Client agrees to inform any and all people who will be on the property, at the request of the Client, or by invitation of the Client, of the terms and conditions, and to monitor compliance with terms and conditions.

  • The Client agrees to hold the Owner free and clear of any liability for damage to self or property, resulting from accident, injury, or loss of enjoyment resulting from events beyond the Owner's control (e.g., the weather).

  • The Client agrees to hold the Owner free and clear of any liability for cancellation which results from any event beyond the Owner’s control, such as acts of nature (e.g., earthquake), acts of governmental agencies, fire, strikes, change in flight schedule, war, illness, and death. NO REFUND will be offered in these circumstances, except as noted in the Cancellation and Refund Policy.

  • The Client agrees to hold the Owner free and clear of any liability for damage to self or property, resulting from accident, injury, or loss of enjoyment resulting from the weather or inoperable appliances or equipment.

  • The Client acknowledges that the release and indemnity provisions in paragraph 2 apply to all claims for injury or damage resulting from any cause, including the negligence of any party released herein. The Client further acknowledges that this agreement shall be binding on all family members, guests, guardians, heirs, and any executor or personal representative or beneficiary.

  • The Client agrees that this Agreement should be enforced to the full extent permitted by law. If any section or part of this Agreement is held unenforceable under the applicable law, the remainder of the Agreement shall be enforced. The release and indemnification provisions of this Agreement do not apply to reckless or intentional acts, unless the applicable law permits such provisions.

  • All disputes, controversies, or differences which may arise between the parties hereto, out or in relation to or in connection with this Agreement shall be finally settled by arbitration in Tokyo, in accordance with the Commercial Arbitration Rules of The Japan Commercial Arbitration Association. The prevailing party in any arbitration or litigation shall be entitled to recover reasonable attorneys' fees.

  • The Client states that the Client is 20 years of age or older and legally competent to sign this Release of Liability and Indemnification Agreement. The Client understands that these terms are contractual and not a mere recital. The Client shall sign this document of their own free act.
